1. Definitions

“Resort”, “we”, “us”, “our” refers to Toma Tungi Resort.

“Guest”, “you”, “your” refers to the person booking or staying at the Resort.

“Booking” means a confirmed reservation for accommodation, services, or facilities at the Resort.

“Website” means the online platforms of the Resort, including tomatungiresort.com (or any other domain) and any mobile site or app.

2. Booking & Payment

Bookings may be made through our Website or by contacting us directly.

To confirm a booking, a minimum advance payment of 50% (and up to 100% at our discretion) is required.

You must provide accurate information at the time of booking, including your name, contact details, and any special requests.

We reserve the right to cancel or refuse a booking if payment is not received by the due time/date, or if we suspect the booking was made under false pretenses.

3. Check-in / Check-out

Check-in time is from 1:00 PM and check-out is by 11:00 AM, unless otherwise agreed.

Early check-in or late check-out may be possible subject to availability and may incur additional charges.

4. Guest Responsibilities

Guests must behave respectfully, consider other guests’ comfort, and comply with Resort rules.

The Resort may refuse service, terminate the stay, or require immediate departure without a refund if a Guest or their party behaves in a manner deemed inappropriate (for example, violence, harassment, or excessive noise).

The Guest is responsible for any damage, loss, or theft caused by them or their party during their stay. The Resort may charge for repairs or replacements.

Consumption of illicit substances or other illegal behavior on the premises is strictly prohibited.

Pets and animals are allowed only if arranged in advance with the Resort and are subject to additional terms.

5. Rates, Taxes & Fees

VAT and taxes are included in the price of the booking unless otherwise stated.

We reserve the right to adjust rates if required by changes in taxes or regulatory requirements.

Any additional services (for example, meals, activities, or equipment) will be charged extra.

6. Cancellation & Amendments

You may cancel or amend your booking subject to our cancellation policy (Booking & Refund Policy).

The Resort reserves the right to cancel or alter bookings in the event of force majeure (for example, flood, cyclone, fire, or government action) or other valid reasons. In such a case, we will endeavor to offer alternative accommodation or provide a refund as outlined in our Booking & Refund Policy.

7. Refund & No-show

If you fail to check in on the scheduled arrival date without prior notice (“no-show”), we reserve the right to treat the booking as cancelled and charge accordingly.

Any refund will be subject to our Refund Policy (detailed on our Booking & Refund Policy page) and will be processed in the manner and timeline described there.

8. Website Usage

By using our Website, you agree not to:

• reproduce, duplicate, or copy any part of the Website;
• use the Website for unlawful or fraudulent purposes;
• upload viruses or malicious code.

The Website content is provided for your personal information and use only. We make reasonable efforts to keep content accurate, but we do not guarantee completeness or error-free status.

9. Intellectual Property

All content on the Website (text, images, graphics, and logos) is the property of the Resort (or its licensors) unless otherwise stated.

You may view or download content for personal use only; you may not copy, modify, distribute, or frame the content without our express written consent.

10. Limitation of Liability

To the fullest extent permitted by law, the Resort shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Website or stay at the Resort.

We make no warranty that the Website will be uninterrupted or error-free, or that any defects will be corrected.

11. Privacy & Data Protection

Our collection and use of your personal data are governed by our Privacy Policy.

By booking or using our Website, you consent to the processing of your personal data as described there.

12. Governing Law & Dispute Resolution

This Agreement shall be governed by the laws of the People’s Republic of Bangladesh.

Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts.

13. Amendments to Terms

We reserve the right to update or change these Terms at any time without prior notice. The updated Terms will be posted on our Website and will apply from the date of posting.
